Your basic personal data has been provided to Exadel by you with the aim to participate in the Affiliate Program as a Partner by making a referral for another person to work for Motion Software JSC.
The scope of the data shared with us is:
For the initial submission of a referral proposal:
- Your name and surname;
- Your email address;
- Your Location;
- Your Linkedin account;
- Your phone number;
In case you become eligible to receive the affiliate bonus, with accordance of the terms and conditions of the Affiliate program, the scope of the data shared with us shall be:
- Your name, surname and last name,
- Date of birth
- Personal identification number
- Your email address,
- Your home address,
- Your bank account number.

Purposes and legal basis of processing:
Your data will be processed in order to perform the contract (art. 6 point 1 letter b of the General Data Protection Regulation) as a Partner in the Affiliate program, as well as in order to fulfill the duty of keeping appropriate accounting documentation (art. 6 point 1 letter c of the General Data Protection Regulation (GDPR) in connection with the Personal income taxes act).
The term of processing:
Personal data will be processed within the period required by law for the storage of accounting documentation (10 years from the end of the tax year).
Data recipients:
Personal data recipients might be persons cooperating with Exadel on the basis of employment, B2B or civil law contract, our clients, entities providing services to Exadel (e.g. IT, legal, accounting), as well as Motion Software JSC (as payer of the affiliate bonus) and state organs (NRA, NII) in cases that are set forth in laws.
Transfer of personal data to third countries:
Due to the use of cloud solutions, your personal data might be transferred outside of the European Economic Area. The legal basis for the transfer (art. 44 and the following of GDPR) is an appropriate data processing agreement based on the Standard Contractual Clauses adopted by the European Commission.
Your entitlements:
You have the right to request from us access to and rectification or erasure of personal data or restriction of processing and the right to data portability, as well as the right to object to processing – in accordance with the provisions of GDPR.
Complaint:
You have the right to lodge a complaint with the data protection supervisory authority if you believe that the processing of your personal data infringes the provisions of GDPR. You have the right to file a complaint before the Data protection commission, situated in 2 Prof. Tsvetan Lazarov str., Sofia 1592 or electronically by the order of the Act on Electronic Document and Electronic Certification Services.
Freedom to provide data:
Providing data is voluntary, however not providing it may make it impossible to start or continue cooperation, e.g. due to Motion Software’s obligation to account for the income tax and Exadel’s right to administer the Affiliate program and administer the recruitment process.
